Smith Says Other Agencies Didn't Cooperate The criminal investigation into political spying by the Anti-Defamation League of B'nai B'rith (ADL) that made national headlines last year came quietly to a close May 27, when former San Francisco Police officer Tom Gerard pleaded no contest to a misdemeanor charge of illegally accessing computer information. San Francisco district attorney Arlo Smith told the Bay Guardian that "the best thing to do was to take a plea [bargain]," after a judge dismissed five felony counts against Gerard in April because the FBI would not release the evidence Gerard said he needed for his defense. The FBI passed its investigation of spying activities of Gerard and ADL agent Roy Bullock to San Francisco officials in 1992. Smith said that even if Appeals Court had reversed the April 29 dismissal, he believed Gerard would have sought the FBI evidence in federal court and the FBI would have again refused. "We would have ended up totally empty-handed." A somber and visibly nervous Gerard initially declared himself "guilty" when visiting Municipal Court judge Jonathan Lehan asked him for his plea. Then, after a quick word with his attorney, Gerard changed his plea to no contest. When Lehan asked him if the allegations were true, Gerard replied, "It's true." Gerard was fined $2,500 and sentenced to three years probation and a 45-day jail term, which he can serve in the sheriff's alternative work program. "The no-contest plea reminds us of the deal with the ADL," says Riva Enteen, spokesperson for the Coalition against Surveillance (CAS), referring to the out-of-court settlement Smith struck with ADL and Roy Bullock last November. The coalition was formed in 1993, after San Francisco officials raided ADL's California offices and found intelligence files on over 500 political organizations and 10,000 individuals. Some CAS member organizations are among the plaintiffs in three lawsuits pending against the ADL, Gerard, and a number of local jurisdictions, including San Francisco. Smith noted that the ADL settlement included an injunction barring the organization from soliciting confidential law enforcement records. "I think the result here in the long run will serve to protect individuals," he said, adding that both the city and the state now have better computer-security procedures. Smith defended his office's investigation. "We've taken every step possible... But it's clear we have not had the cooperation of other agencies." The ADL, in many instances has sought to squash any concerted, militant, organized response against the neo-Nazis, KKK, and other forces on the racist, anti-Semitic far-right. 2. The FBI, in all liklihood, sabotaged Smith's case against Gerard because they refused to release information pertinent to the case, just as they did with ADL operative, Roy Bullock, last November. 3. Bullock used some of the information he gathered on the anti- apartheid movement and SOLD it to South Africa's Bureau of State Security (BOSS), an organization loaded to the gills with neo- Nazis and anti-Semites. 4. Gerard, took a leave of absence in the '80's from the SFPD and was a contract employee with the CIA in El Salvador. As an "intelligence specialist," Gerard sought to "immunize" himself with the courts when he threatened to release information that would be "damaging" to the Company. Some of the "top secret" evidence he sought would have DIRECTLY LINKED THE CIA TO THE "DEATH SQUADS, this is to say, to the Salvadorean Army, National Guard and Treasury Police. None the less, these facts came out anyway; a watered-down version by the UN-sponsored "Truth Commission," a series of articles by progressive journalist Allan Nairn, and a series of excellent background articles published by La Prensa/El Diario, a Spanish language daily out of NYC. Lest we forget, Roberto D'Aubisson, founder of the far-right ARENA party in El Salvador, was also a top leader in the Taipei-based World Anti-Communist League (WACL), a notorious organization often referred to as the FASCIST INTERNATIONAL. WACL has received major funding for their "work" from the Rev. Sun Myung Moon's UNIFICATION CHURCH, Japanese yakuza crime families, "ex" Nazis such as the infamous Klaus Barbie, and Gen. John "Blackjack" Singlaub of Iran/Contra fame. 5. Bullock/Gerard targeted both progressive, left-wing, Christian Right, racist, anti-Semitic, and openly neo-Nazi groups indiscriminately. In their capacity as ADL operatives, they passed information on Palestinian activists engaged in constitutionally-protected political activities to Mossad -- the Israeli political police. We know neither the CONTENT of the information they passed nor its accuracy. 6. BACORR, hardly a group with anti-Semitic ties, was targeted by Bullock & Gerard, most likely because at the time of the imperialist slaughter aka the Persian Gulf "war," BACORR was a steering committee member organization of one of the major anti- war coalitions -- a VERY ACTIVE ONE, I'll add proudly. 7. The fact that FAR-RIGHT, anti-Semitic outfits such as The U.S. Labor Party (one of the multiple metatases of the LaRouche organization) or the Nation of Islam, denounce the ADL (or Zionism for that matter), does not automatically transform critics of the ADL or Zionism into anti-Semites. Yes, one CAN be a principled anti-Zionist without being either an anti-Semite or a fascist. 8. The USLP/NOI have had LONG STANDING CONNECTIONS to the premier anti-Semitic organization in the U.S. -- Willis Carto's Liberty Lobby/Populist Party/Populist Action Committee/Institute for Historical Review/Spotlight. It would perhaps, be relevant if BACORR reviewed some of this history. Many, many other "notables" on the far-right, including Col. "Bo" Gritz, David Duke, neo-Nazi, and Tom Metzger are similarly connected. 9. The ADL, as I said earlier, has a long history of turning their backs on the street actions of the fascists. This is EXTREMELY DANGEROUS. By "ignoring" neo-Nazis when they rear their filthy heads in public, it legitimizes their hatred and their genocidal plans for Jews, Blacks, other people of color, queers, and the Left. Imagine what the results would be if BACORR took a similar position and urged folks to "ignore" Operation Rescue! 10. Chip Berlet on the conference on peacenet has run an excellent series of articles on the ADL exposing HOW THEY HAVE WORKED HAND & HAND WITH THE STATE. Berlet is neither an anti- Semite nor a fascist fellow-traveler, but a progressive researcher who has documented the sordid history of FBI/neo-Nazi connections vis a vis Carto, David Duke, and the LaRouchites. Another excellent source is the book by Dennis King, "Lyndon LaRouche and the New American Fascism," available in hardback from Covert Action Quarterly, 1500 Massachusetts Ave. NW #732, Washington, DC 20005 -- only $10! Check it out; it's a real eye- opener. 11. More discussion is needed on this topic; given the upsurge of anti-Semitism and racism in the United States as well as the proliferation of various "cottage industries" of the Christian Right such as sexism and homophobia.
