Congratulations on choosing The Little Garden, we hope think you'll be pleased. You received this because: you've read the FAQ and filled out the order form. You know basically what we're up to, and are reasonably sure you have the necessary parts and pieces. It's time to start creating your connection, by exchanging basic info (contact, billing, subnet, etc). At the end of this file you'll find a short, to the point form that (1) gives YOU information (which POP you'll connect to, your subnet, etc) and (2) provides US with contact information. @1: ONCE YOU RETURN THE FILLED-OUT FORM: Before we actually purchase equipment needed to complete your connection, we require that you pay the INSTALL fee. The amount is given on the ORDER FORM at the end of this document; you will also receive in the mail a printed invoice for the INSTALL portion plus your first three months regular service. You can wait until you receive the printed invoice before paying, but TLG will not schedule the connection until it is paid. You can prepay you install fee by mailing a check to the TLG billing address: The Little Garden 3004 16th Street #201 San Francisco CA 94103 IMPORTANT INFORMATION FOR LEASED-LINE/FRAME RELAY CUSTOMERS: DO NOT ORDER LINES BEFORE CONTACTING TLG! You must discuss with us critical details of line installation; this will affect which carrier you use. This includes TLG scheduling you into our installation calendar. We will schedule installation of your connection once we receive your installation fee. We schedule a full calendar week, seven days, to complete the line install phase. TLG will need to know the Circuit Number, though one may not be assigned until the installation is complete; in this case, send in the Form below anyways with whatever information you have (order number, etc), if any. And please follow up with email when you get the Circuit Number. @2: REGULAR MONTHLY BILLING STARTS: Billing for monthly TLG services will begin two weeks after the date on your install invoice, issued when you return the completed ORDER FORM, below. TLG billing starts at the first of the month, and is payable upon receipt. We bill monthly for all services except Full-time, Modem based service, we bill you ahead for three months of service. If you want other arrangements, please let us know AHEAD OF TIME. Your first month is treated specially. First, the turn-on/billing time is rounded up to the nearest 1/4th month; ie. if you were connected on the 3rd of the month, we'd round that up to the 7th, and bill you for 3/4ths of a month. From them on, billing is done on the first of the month. @3: IMPORTANT -- READ THIS! INSTALL FEES ARE DUE IMMEDIATELY UPON RECEIPT OF THE BILL -- we reserve the right to stall or stop installation if the install bill is not paid promptly. INSTALL FEES ARE NOT REFUNDABLE. Installation fees cover our labor, and the actual cost of providing your connection. T H E L I T T L E G A R D E N 1 May 94 Service agreement SERVICES PROVIDED * Full, unrestricted access to TLG. * Full access to NSFnet and associated regional networks subject to NSF approval and compliance with the NSF Appropriate Use Policy. * Full maintenance of all TLG-owned equipment. TERMS AND CONDITIONS TLG exercises no control whatsoever over the content of the information passing through TLG. You are free to communicate commercial, noncommercial, personal, questionable, obnoxious, annoying, or any other kind of information, misinformation, or disinformation through our service. You are fully responsible for the privacy of, content of, and liability for your own communications. TLG makes no warranties of any kind, whether expressed or implied, for the service it is providing. TLG also disclaims any warranty of merchantability or fitness for any particular purpose. TLG will not be responsible for any damages you suffer or inflict on others. This includes loss resulting from delays, non-deliveries, misdeliveries, or service interruptions caused by its own negligence or your errors or omissions. Use of any information obtained via TLG is at your own risk. You are responsible for determining whether or not the traffic you originate will end up being carried on another network, and for following the rules of any such networks. TLG specifically denies any responsibility for the accuracy or quality of information obtained through its services. Any access to other networks connected to TLG must comply with the rules appropriate with the other network. This specifically, but not exclusively, includes NSFnet. Use of TLG itself may be for any purpose. Use of TLG for commercial purposes is both permitted and encouraged. Payment is due 30 days after date of invoice, except installation fees which are due upon receipt of invoice. Accounts are in default if payment is not received within: 15 days for install fees, or 45 days for all other invoices after date of invoice. If your payment is returned to us unpaid you are immediately in default and subject to a returned check charge of $50 from TLG. Install fees unpaid after after 15 days, or any other account unpaid 60 days after date of invoice may have their service interrupted. Such interruption does not relieve you of the obligation to pay the charge. Only a specific request to terminate your service relieves you of your obligation to pay the monthly account charge. Accounts in default are subject to an interest charge of 1.5% per month, or the maximum allowable under your state's law, on the outstanding balance. If you default, you agree to pay TLG its reasonable expenses, including attorney and collection fees, incurred in enforcing its rights under these Terms and Conditions. Service is invoiced for three months in advance for modem-based connections, and monthly in advance for all other services, and may be canceled in writing with 30 days notice with no penalty. TLG reserves the right to change rates and otherwise modify these Terms and Conditions by notifying you 60 days in advance of the effective date of the change. These terms and agreements supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted.
